From now on, hospitals must refute medical errors themselves, the burden of proof no longer lies with the patient | Inland

The patient with severe back pain had received an epidural in a university hospital, after which he developed a hospital infection. The man remained incapacitated for work and started a lawsuit.

In the past, the patient had to be able to demonstrate that an error has been made. A new law now says that the hospital itself must be able to demonstrate that it has taken all precautions. In this case, the hospital refused to prove this and the man was proved right. It is the first time that a court has invoked the new law.
