The defendant has accepted a sentence of 15 months in prison for publishing a video recorded in China posing as a scene that occurred in Barcelona

The tweeter who posted a message against unaccompanied migrant minors in July 2019 has admitted this Tuesday at the Barcelona Court that he committed harmed the dignity of this group and has accepted the sentence requested by prosecutor Miguel Angel Aguilar of 15 months in prison and a fine of 1,600 eurosas well as the disqualification for five years to exercise a profession in the educational, teaching or leisure field and the confiscation of their accounts on social networks, which have already been closed by the same defendant. It is the first sentence in Spain for a ‘fake news‘or fake news of these features. The accused has said a brief “yes” when asked by the robes if he was in agreement with the previous agreement reached by the defense and the prosecution.

The prosecutor has requested the suspension of the execution of the sentence, which has been dictated ‘in voce’ by the court, in exchange for the prohibition of creating new profiles on the internet that are discriminatory for two years and attendance at an equality course treatment and discrimination. The defense attorney, Sebastián de Juan, on behalf of his representative, has accepted the request of the public prosecution. Given this pact, the magistrates will almost certainly reflect in the final sentence the suspension of the execution of the sentence with the conditions raised by the prosecution.

The 45 second video

In its provisional indictment, the prosecution claimed a slightly higher sentence for the defendant, specifically two years in prison. To your understanding, the accused acted “moved by his animosity and rejection & rdquor; to immigrants of Moroccan origin and, among them, “the most vulnerable sector”, such as unaccompanied immigrant minors or ‘menas’. The message that has brought him to the dock was published on July 1, 2019 in Twitter and prayed: “Here you have the video of the mena Moroccan from Canet de Mar (Maresme), to those of us who are going to give the little payment until they are 23 years old, the children of Pedrito Piscinas. By the way, then to make matters worse, these madmen and these packs of Moroccans will not appear in the media & rdquor; [sic]. This text was accompanied by a 45-second video showing an attack committed by a man in China that had nothing to do with the Catalan population.

In the video, which was viewed 21,900 times, a man was seen brutally assaulting a woman, giving her 15 punches and seven kicks to the head and leaving her unconscious. After her, she tries to pull down her pants and grabs her hair and drags her along the ground until she disappears from the field of view of the surveillance camera recording the events. That filming was made on June 22, 2019 and corresponds to an attack that took place in China that was released by the authorities of the Asian country to identify the bad treater through citizen collaboration.
