Last Tuesday, April 12, the portal acodap (Association against Corruption and in defense of Public Action) published an alleged news titled: ‘Bombazo!!! Zapatero and Dolores Delgado imputed by the National High Court’. The falsehood intended to support itself in a written complaint presented by the aforementioned entity -run by the former judge expelled from the judicial career for the crime of prevarication Fernando Presencia- admitted for processing by court number 6 of the National High Court and sent to the Public Prosecutor’s Office for reporting. On Wednesday the 13th, the judge in charge, Joaquín Gadea, after receiving a letter from the Anti-Corruption Prosecutor, filed the complaintfor lack of a minimum sustenance and support in element or principle of evidence” and for the “rough composition of some letters” in which they spoke of alleged bank accounts of the Attorney General of the State in a Panamanian financial entity to which, according to former president José Luis Rodríguez Zapatero, transfers of 150,000 euros would be made up to 3 million euros.According to the judge, “the possibility of documentation created ex profeso for the fact that is denounced”. And he attended to the dean court of Talavera de la Reina (Toledo), domicile of the association, the proceedings for a “further action in order to investigate the possible spurious character of the same & rdquor ;.
Good morning green sleeves.
Look where, the State Attorney General, Dolores Delgado, used Acodap when she was interested in her plan -conceived when she was Minister of Justice of the Pedro Sánchez government- to remove the prosecutor Ignacio Stampa of the investigation of the ‘Tándem-Villarejo case’.
Precisely, a complaint from the aforementioned association, without any basis, was invoked by the chief prosecutor of the technical secretariat, Álvaro García, to extend some investigative proceedings, after the investigating prosecutor of the same, Carlos Ruiz de Alegría, proposed on October 5 and 23, 2020 the file because it is an untested montage.
Acopad’s complaint rained on wet.
Because the State Attorney General’s Office attended the Prosecutor’s Office of the Superior Court of Justice of Madrid in July 2020 a complaint by the far-right party Vox against the prosecutor of the ‘Tándem-Villarejo case’, Ignacio Stampa, supported by newspaper clippings in which the aforementioned prosecutor, and his partner Miguel Serrano, appeared as alleged authors of leaks of the summary. The clippings contained articles by a journalist named María Montero.
The Prosecutor’s Office gave instructions to investigate prosecutor Stampa because the other possible perpetrators, it maintained, were already under judicial investigation, which was untrue.
The interest of the FGE was to keep the proceedings alive at least until after October 27, 2020, the date on which the Fiscal Council, an advisory body to the Attorney General, resolved to award eight permanent positions in the Anti-Corruption Prosecutor’s Office. Stampa, who was on secondment after three and a half years, aspired to one of them. The prosecutor, with an investigation behind him, came in clearly disadvantaged conditions compared to the other candidates.
The tax instructor of the proceedings in the Superior Court of Justice of Madrid, the lieutenant prosecutor Carlos Ruiz de Alegría, proposed on October 5, 2020 -after investigating four months- filing the proceedings upon discovering the montage against Stampa. But Álvaro García, Delgado’s right-hand man, asked prosecutor Alegría to carry out further investigations. On October 23, after performing them, he once again proposed the forceful file of the proceedings.
Register
On October 24, 2020, Prosecutor Stampa and a team of policemen entered and searched the cell of former commissioner José Villarejo, in Estremera prison. They had data, coming from wiretaps, according to which Villarejo, an associate of his in prison, the lawyer Alfonso Pazos, in second degree prison, and the journalist María Montero, Stampa’s whistleblower, they maintained a connection to spread information about the summary and endorse the responsibility of it to the prosecutors.
The prosecutors Stampa and Serrano, after various proceedings, asked Judge Manuel García Castellón to summon María Montero to testify as accused of collaborate with the Villarejo criminal organization.
Eighteen months later, said citation is pending before the judge.
But the entry into Villarejo’s cell had consequences. Behold, before the Fiscal Council, which was to pronounce on October 27, on the permanent positions in the Anti-Corruption Prosecutor’s Office, Acodap sent on October 26, 2020 at 8:14 p.m. (stamp of the General Registry of the Prosecutor’s Office General of the State of the 10:19 hours of October 27, 2020) a new writing.
“Acodap, led by the former dean judge of Talavera de la Reina Fernando Presencia, acting on his own behalf and in defense of his associate, the journalist María Montero Clemente, files a complaint against the prosecutor Ignacio Stampa Fuente for considering that the facts that he has made known through a letter could constitute an act of retaliation related to the protection of people who report violations of Union Law & mldr; & rdquor ;. On October 28, Presencia also filed a complaint with the Tax Inspectorate.
In turn, on October 29, María Montero wrote to the FGE expanding her complaint “at the individual level, covered days before [26 de octubre] by the Acodap Association & rdquor ;.
Aware
Although the State Attorney General has assured the Fiscal Council that she had not intervened in the proceedings against Stampa, on November 1, 2020, she proved to be aware of the new complaint about which the chief prosecutor of the technical secretariat, Álvaro García, He had not yet requested – without any authority to request them – proceedings from the investigating prosecutor Carlos Ruiz de Alegría.
When asked why the FGE did not notify the Fiscal Council on October 27, 2020 -which decided not to award the fixed position to Stampa- that there were proposals to file, Dolores Delgado answered: “The proceedings opened against Mr. Stampa remain in force until the investigation is exhausted, which could be pending new actions & rdquor ;.
thin, so warned about “new actions & rdquor; one month before said actions were requested by Álvaro García to the prosecutor Ruiz de Alegría. That request took place on December 2, 2020.
The State Attorney General’s Office, the chief prosecutor of the Tax Inspection, Fausto Cartagena, and the investigating prosecutor Ruiz de Alegría were aware that both María Montero and Apocad went hand in hand and fed each other.
On November 10, 2020, Álvaro García blessed the decision to accumulate in the Prosecutor’s Office of the Superior Court of Justice of Madrid the new complaint “formulated by Apocad in defense of his associate María Montero against the prosecutor Ignacio Stampa & rdquor ;.
On November 20, 2020, Ruiz de Alegría considered “received the last two complaints filed by Apocad on behalf of María Montero and the second, from her directly & rdquor ;. And he warned after reading the content: “Join these investigative proceedings, without prejudice to the null relevance they have for the purpose of modifying the assessment that we already made explicit in the two file reports [5 y 23 de octubre] of the actions that appear in the proceedings & rdquor ;.
Because the instructor, as he told El Periódico de Catalunya, considered completely inconsistent those writings in which all previous complaints were refuted.
Reaction of the Association of Prosecutors
The president of the Association of Prosecutors, Cristina Dexeus, explained that “beyond Stampa’s professionalism, there was media pressure that we felt had to be cut”. She supported Stampa’s denial of the position because “the fact that there was media noise, partly driven by the parties, we thought could harm the appearance of impartiality and the cause itself.”
