Daycare is allowed to remain open after rules have been violated

Daycare center XXS in Uden has been allowed by the judge to remain open. The municipality of Maashorst actually wanted to close the daycare next Monday because the daycare center does not meet all the requirements. The judge is now putting a stop to that.

The municipality announced this week that XXS would have to close from this Monday. This has to do with requirements that the shelter does not meet. For example, employees in a group of children aged one year and older must be regarded as ‘regular faces’. An inspection report from the GGD showed last month that this was not the case. The municipality announced on Wednesday that the shelter would therefore close on Monday.

According to the childcare center, it is a little more complicated and other familiar faces were placed in groups because several people were on maternity leave. XXS Uden therefore appealed to the municipality against the closure and also asked the judge for a ruling.

Pronunciation
The fact that XXS is allowed to remain open partly has to do with the date of the ruling. The judge cannot consider the issue before Monday because that is too short a day. Because, according to the judge, the safety of the children is not at risk, the shelter may remain open in the meantime until a ruling has been made. The judge assumes that there is a fixed face for children aged one year and older.

The case will be heard on February 12.
