A 57-year-old man from Dalen has been sentenced to one year in prison for having sex with his underage girl next door, six months of which are suspended.
This happened in the period from June 2014 to July 2019 in Emmen, where the man lived at the time. Together with his father, he regularly looked after the child during that period, when the mother was at work. According to the judge, the fornication consisted of groping the child.
The sentence is lower than the requirement of twenty months, ten of which are conditional. The Public Prosecution Service (OM) also found evidence that the man allowed the child to watch sexual acts he performed on himself. There was not enough evidence for that, according to the judge.
The man denies the fornication. At most, he touched the child accidentally while dancing, he said. A different picture emerges from WhatsApp conversations with the mother, according to the judge. He judged that the Dalenaar only had an eye for his own lust.
The man in his fifties has not been convicted before. He must pay the victim compensation of 5,000 euros.
