Last month, the Public Prosecution Service (OM) demanded another eight months in prison against Van Everdingen in the appeal against the earlier acquittal by the court in 2019. The court demanded five months in prison against project developer Fred Meijer and against a subsidiary of KPMG, which ordered the construction of the headquarters, a fine of €100,000 was demanded. But this too is now dismissed by the court.
According to the Public Prosecution Service, the tax fraud consisted of the fact that the costs for furnishing the building (of €39 million) were deducted in one go from the profit of the KPMG subsidiary that built the building. According to the Public Prosecution Service, these should have been spread over the rental period of fifteen years. Tax advantage would have been obtained in this way.
Not proven
The court finds all this not proven and states that there was no intent to commit tax fraud. In addition, the Tax and Customs Administration was informed in advance by letter about the sales profit of the project and the higher costs of furnishing the property.
