The TSJ of Galicia orders the National Police to grant compensation to the agent injured during the protests in the Catalan capital during 2019
The High Court of Justice of Galicia (TSJG) has ordered the National Police that indemnifies with €165,258 to an agent who suffered a head injury in the riots that took place in Barcelona after the sentence of the ‘process‘, since at the age of 41 he saw “his future ruined” and has had to retire. The agent, attached to the VII Police Intervention Unit based in Vigo (Pontevedra), was assigned to Barcelona on October 18, 2019 within the framework of the “operation icarus“, to reinforce the police device due to the riots in the Catalan capital after the conviction of the leadership of the ‘procés’. And he suffered injuries while he was mobilized before the police station of Via Laietana.
This has been agreed by the TSJG in a sentence, to which EFE has had access, which partially agrees with the policeman who was seriously injured in the act of duty on October 18, 2019 and had to be admitted to the ICUand that it condemns the General Directorate of the Police to compensate him with 89,858.88 euros for the consequences of his injuries and with 75,399.83 euros for patrimonial damage due to the loss of quality of life.
The policeman, who had been deployed in the Via Laietana Barcelona, in the vicinity of the Police Headquarters and the urquinaona squarethe epicenter of the riots, received a strong blow to the head that broke his helmet, causing him to collapse unconscious to the ground and suffer a head injury for which he had to be admitted to the Intensive Care Unit (ICU) for several days. in serious condition.
The court concludes in its ruling, which can be appealed, that the agent has the right to be compensated because he is a 41-year-old police officer with no health problems in 2019 but who, due to a “brutal assault suffered in the performance of his professional performance, as a guardian of public order, saw his future ruined, prey to absolute permanent disability that forced him to become a retired person”.
Permanent disability
Specifically, due to the serious injuries suffered, the agent was granted retirement in November 2020 for permanent disability for the National Police service, being disqualified for any profession or trade. At the same time, the agent had denounced the assault suffered before a Barcelona investigative court, although, despite the investigations carried out, the perpetrator could not be identified.

However, in December 2021, the General Directorate of Police dismissed his claim, alleging that his responsibility was limited to the expenses for his recovery, already assumed by the administration, and subsequently opposed the agent’s legal claim and requested that reject the same in its entirety, without the right to any compensation, despite the seriousness of the injuries.
