Cell and TBS for violent explosion at the Salvation Army Emmen

For attempted murder at a location of the Salvation Army in Emmen, the public prosecutor demanded a prison sentence of 2.5 years and TBS with conditions against a 40-year-old Emmenaar. The man kicked and punched a roommate in the head. That could have been fatal, the prosecutor said.

The forty-something had been having problems with this fellow resident for a long time. “He behaves badly towards women,” the man told the court. The man was cooking and stood just outside the building, ladle in hand. After an altercation, he hit the victim on the head with a spoon. Both got into a fight.

The 40-year-old man received help from a 36-year-old inmate and a 24-year-old man from West Friesland. The youngest was visiting the 36-year-old. The victim himself called the police.

The officers found the oldest suspect on his bed. His front teeth were in his palm. He addressed the police in confusion. The fight was captured on video by a security camera.

The two other suspects were also on these CCTV images. The 36-year-old man was arrested at the reception location, the youngest at Amsterdam Central Station. He had run away from an institution for frequent offenders. The accuser found their role smaller, but sufficient for complicity in attempted manslaughter.

The 36-year-old man was sentenced to thirty months in prison, of which ten months were suspended. The youngest should have been sitting for a year and a half.

The 40-year-old suspect has been convicted many times for violent cases and domestic violence. The man suffers from a personality disorder and a cannabis use disorder. The criminal offense can be imputed to him to a lesser extent. Previous treatments have yielded little, despite the man’s cooperative attitude.

Tbs without forced nursing should be sufficient, the prosecutor said.

The 40-year-old was on probation with a one-year suspended prison sentence and the 36-year-old man still had three months in prison. They should also serve both of them, the prosecutor said. According to the defense, the demand is too strong and attempted manslaughter has not been proven.

The court will rule in two weeks.
