Borger-Odoorn has to do homework again in the Valthermond rottweiler kennel case

A Rottweiler breeder in Valthermond can continue breeding dogs for the time being. The municipality banned breeding activities, but the administrative judge has now put a stop to that.

The case revolves around a breeder in Valthermond who, according to the municipality, breeds dogs commercially at his home, while this is not permitted without a permit. The breeder was then forbidden by the municipality to continue breeding the four-legged friends and offering puppies for sale.

The breeder did not agree with that decision and went to court last December.

Municipality too unclear

It determines that Borger-Odoorn has not made it sufficiently clear why the breeder’s activities are contrary to the rules. According to the judge, the municipality should have made it clearer how many dogs are involved in a business activity.

Eleven Rottweilers are currently walking around the breeder’s yard. Neighbors experience noise and odor nuisance and complained to the municipality about the breeding practices at an earlier stage. The municipality believes that the breeder is acting illegally and imposed a breeding ban.

Although, according to the administrative judge, it appears that the Valthermonder operates commercially, the municipality cannot sufficiently substantiate this. The imposed breeding and sales ban must therefore be lifted, the judge rules. He gave the municipality homework if it still wants to impose a ban.

It is still unclear what Borger-Odoorn does with the ruling. The municipality could not yet be reached for a response on Tuesday.
