The government wants to punish serious and dangerous traffic violations more severely and relatively minor traffic violations lower. That is why, as of 1 March 2022, for example, the fine for holding and using a mobile phone while driving will be increased to 350 euros; before this date, this fine was 250 euros. At the same time, for example, traffic fines will be reduced for speeding on the highway for the first 10 km/h above the speed limit. These speeding fines are reduced by 15%.
Based on advice from the Facts and Tariffs Committee, which includes experts from the police, the Public Prosecution Service (OM) and the Central Judicial Collection Agency (CJIB), it was decided last year to fine a number of more serious traffic violations. The extra fine receipts from this will be used to reduce the fines for minor traffic offences. Road safety is expected to be enhanced by stricter penalties for serious traffic offences. At the same time, social acceptance will be increased by reducing the fines for minor violations.
Number of higher and lower penalties in a row
In addition to the higher fine for detaining mobile (communication) equipment, the following offenses are also punished more severely:
- Do not drive on the right as much as possible (unnecessarily driving on the left) on a car (highway) road from 150 euros to 220 euros.
- Failure to give way to a priority vehicle (such as a police car with flashing light and siren) from 250 euros to 350 euros and transfer it to criminal law.
- Increase the transport of minors without a seat belt from 150 euros to 220 euros.
In addition to the lighter penalty for minor speeding offenses under 10 km/h, the sanction is also reduced for the following facts:
- Causing unnecessary noise with a motor vehicle from 400 euros to 250 euros.
- Passing passengers in and out without giving them the opportunity to get in or out from 400 euros to 250 euros.
- Parking in a disabled parking space from 400 euros to 310 euros.
- The fine-free rate will also be introduced for the first 3 kilometers of speeding on the 130 km/h roads. On all other roads, the ticket-free rate already applies. Now the exception for speeding violations on 130 km/h roads has been removed.
The adjustments to the traffic fine system were submitted to parliament at the end of last year by means of an order in council (AMvB) and will now come into effect on 1 March 2022. All current fines can be found in the fine base of the Public Prosecution Service: https://boetebase.om.nl/
