Nuisance asylum seekers can be placed in Ter Apel from 1 June in a strict, sober and freedom -restricting regime. Minister Faber (asylum and migration) writes this in a letter to the Lower House.
At the request of the Minister, the minister’s request was already started with the pilot for process availability approach with a reporting obligation and stricter supervision. That approach is for asylum seekers with a disadvantaged asylum application that are accelerated by the procedure. It is now added that the freedom of movement of nuisance providers in a process availability location (PBL) can be further limited.
In the PBL, asylum seekers must stay 24 hours a day in a limited area on and around the AZC and are then no longer allowed to travel to the residential and village centers of Ter Apel and Nieuw Weerdinge. A violation of the tightened rules can lead to a certification.
The reopening of the renewed process availability location is a breakthrough because the court ruled last March that placement in this regime was unlawful. As a result, placement on a PBL was forced to stop.
The renewed approach offers opportunities to impose various forms of freedom -restricting measures after nuisance. The legal basis is that it is always determined individually and with reasons which measure is imposed within the escalation model. In addition, more and more serious measures can be imposed if the asylum seeker continues to show nuisance behavior. Steps can also be skipped and, for example, storage can be imposed immediately.
Minister Faber: “I think it is indigestible that asylum seekers who come to our country for safety, intimidate residents and cause insecurity. These nuisance pendators deserve the heaviest possible approach. I don’t tolerate any nuisance. Not now. Never.”
