In the case of Rune Jarstein’s lawsuit against his dismissal from Hertha BSC, the goalkeeper and the Berlin football club were unable to reach an agreement in court on Wednesday.
The lawsuit Jarsteins should now be continued at the beginning of March in a chamber meeting. According to the club, the Norwegian had a violent dispute with the goalkeeping coach Andrew Menger done and was then suspended by the club.
“The form, the manner and the language were not okay in this situation,” said Hertha’s managing director Fredi Bobic afterwards. Jarstein’s lawyer Horst Kletke said on Wednesday after the conciliation hearing in the Berlin labor court: “Unfortunately, we still have no progress on the grounds for termination. It has to be very specific now, what went how and where?”
Kletke represented the 38-year-old goalkeeper in the proceedings. Lawyer Johan-Michel Menke was there for Hertha. Some fans of the Bundesliga club were also present as spectators at the event.
In the letter of termination dated November 30, 2022, the only reason given was an “inappropriate choice of words in an internal conversation,” Kletke said. This is not specific enough. “He’s never been guilty of anything. First and foremost it’s about his reputation and his honor.”

Menke kept a low profile during the negotiations about the details of the termination: “I can say that this is an overall complex that also needs to be well prepared.” Jarstein switched to the capital club in 2014 and played there for around eight and a half years. He’s not doing well at the moment, said Kletke. “If you suddenly get knocked off a horse while galloping and you don’t even know why, then you don’t feel good.”
At the chamber meeting on March 2nd, the effectiveness of the dismissal is to be negotiated again. Until then, both parties have six weeks to explain their positions in writing. The judge ordered Jarstein and a Hertha representative to appear for the appointment.
