A 45-year-old Syrian man is not punished for forcing ambulance staff to take him to the hospital. The man was ultimately not taken by the ambulance from the asylum seekers’ center on 27 October. Then there is an attempted coercion and that was not blamed by the Public Prosecution Service (OM).

During that period, the man shared a space in the center in Assen with 14 other men. Because of his poor health, he couldn’t handle that, he said. He had several times asked for a room alone. But every time that request was rejected, he told the judge on Thursday. The tensions in the room rose and it came to a scuffle between him and another man that day.

A security guard jumped in between. The suspect spit him in the face. Then he collapsed. An ambulance was immediately called. The ambulance personnel investigated the man who managed to be taken to the hospital. His blood pressure was very high. Earlier a vein had already been snapped by his heart. The man was afraid that this would happen again.

The nurses concluded that there was no reason to bring the man. The man reacted furiously. The ambulance personnel felt threatened and left without the suspect. For coercion and insult, the public prosecutor demanded a conditional prison sentence of a week. The judge believes that there is no coercion, but an attempt to do so. And that was not on the charged leggings. The man was acquitted on this point.

The judge can only assess what is on the charged leggings (the accusations, ed.). If the OM had described: ‘coercion or attempt to do so’, the man could have been convicted of this. Now he was only convicted of insult: spitting in the face of the security guard. He received a two -day prison sentence, he served in custody.
