Another penalty for controversial dog breeder in Eersel

The controversial dog breeder in Eersel has again been imposed a penalty of 2500 euros. This is the seventh time in a row. Municipal inspectors found 173 dogs at the breeder, the municipality announced on Thursday.

That’s two more than last week. The breeder has to leave because of a ruling by the Council of State. The breeding is illegal there, in violation of the zoning plan. In his own words, the breeder sees no possibility to move, because no more dogs would be sold due to all the negative publicity.

After the ruling of the Council of State, the municipality announced that it would check every week for a total of ten weeks. The seventh check is over, three more will follow. The breeder can expect a maximum penalty of 25,000 euros if he has not left after ten weeks.

So far, the breeder has not budged. Earlier, lawyer Rogier Izeboud from Breda, who specializes in environmental and administrative law, explained that the net around the breeder is closing. “Once the maximum of 25,000 euros is reached, the municipality can start collecting the money. And to get that, a bailiff can even seize.”

But if Paridaans chooses to continue with its dog breeding business, the municipality can again impose a penalty. “And it will be a lot higher then,” expects Izeboud. “And I also think they can easily go higher. In my practice I often see much higher amounts than those currently imposed on the breeder.”

As a last resort, the municipality of Eersel can apply administrative coercion, Izeboud knows. “The municipality can then literally lock up the company and thus actively terminate it. And, for example, removing all kinds of stuff and animals.”

Earlier, the Dutch Food and Consumer Product Safety Authority NVWA removed 435 dogs. This is because the breeder took insufficient care of the animals. Many animals had health problems and were kept in pens that were too small.

On April 12, an NVWA inspector was allegedly attacked by a visitor at the breeder. According to the NVWA, there is an atmosphere of intimidation and sometimes aggression during inspections. Something that was previously denied by manager Stephanie Dul of the Eerselse Kwispel breeding farm. According to her, the breeding company cooperates with every check.
