The Dutch can think along
The government wants to tackle remarkable tax constructions. The Ministry of Finance has started a project to this end, which looks at the entire tax system. In the first phase, the remarkable tax constructions are mapped out. Part of this is an internet consultation, for which the ministry calls on the Dutch to contribute remarkable constructions. Spring 2023, the first remarkable tax constructions to be tackled will be presented. This should lead to revenue of €160 million in 2024 and ultimately €550 million structurally from 2027. The government has already decided on this.
Remarkable tax constructions
There is a remarkable tax construction if a taxpayer pays as little tax as possible by structuring, transforming or shifting transactions, income, profit and assets. In such constructions, use is made of the differences in tax rates, bases, exemptions or deductions. These are cases where the letter of the law is acted upon, but not the spirit of the law.
State Secretary van Rij (Tax and Tax Authorities): “I think it is undesirable that our tax system makes it possible for taxpayers to pay as little tax as possible in this way. Tackling unusual tax constructions is therefore an important step towards a more balanced and neutral tax system that works out as intended for every taxpayer. “
Plenty of options
The Wealth Distribution IBO has shown that our tax system inadvertently allows for several remarkable tax structures that allow taxpayers to reduce the tax burden on unwanted ones. In its response to this study, the government indicated that fiscal imbalances and unusual tax constructions are undesirable and that the government wants to tackle them.
What can you do?
With the internet consultation we appeal to a broad target group. We focus on private individuals, entrepreneurs, employees of a company, members of an organization, (board) members of a foundation or association or persons who work as civil servants in the government. If you are familiar with a remarkable tax construction, please complete the questionnaire www.internetconsultation.nl in. This is possible up to and including 31 January 2023. All responses to the internet consultation will be included in the total inventory of constructions.
Further planning
In addition to the internet consultation, the Ministry of Finance itself (including the Tax and Customs Administration) also maps out remarkable tax constructions. After the internal and external inventory, round table discussions are organized with stakeholders about the results. Subsequently, an assessment is made of which remarkable tax constructions are to be tackled. In the spring of 2023, the first implementation of the approach to remarkable tax constructions will be presented. This approach to remarkable tax constructions should lead to a revenue of €160 million in 2024.
