One and a half years in prison demanded for serious assault in the center of Emmen

For attempted serious assault, prohibited possession of weapons and threats in the center of Emmen, eighteen months in prison has been demanded against a 21-year-old Emmen, of which four months are conditional. According to the Public Prosecution Service, the suspect put a gun to the victim’s head during the argument.

The assault was the result of a discussion about broken glasses at a party. The fight moved to Raadhuisplein, where one of the fighters pulled a gun. The 21-year-old suspect took that weapon and put it on the head of the victim, which was on the ground.

The resident of Emmen pulled the trigger. Nothing happened, the weapon was empty. “I had already seen that,” the man told the judge. Then he jumped several times with his full weight on the man on the ground. The victim lost consciousness.

Security cameras recorded the violent incident. “I was shocked when I saw the images,” the man told the judge. The victim’s injuries were limited. The man’s lawyer thought that attempted aggravated assault could therefore not be proven.

The suspect was also on trial for using a stolen debit card in Emmen in August 2019. He received the card from an unknown person, who asked him to get cigarettes. The pin transaction of the Emmenaar was on the screen. The prosecutor found theft proven.

According to experts, the Emmen has a personality disorder, which means that he is less accountable. Without treatment, the risk of recurrence remains. In order to get a treatment off the ground, the prosecutor demanded a partially suspended prison sentence.

The court will rule in two weeks.
