Court: Corona special regulation does not apply after cheating in an exam

After an attempt to cheat, the special corona-related regulation for repeating failed exams does not apply to a student. That was decided by the administrative court in Berlin, as announced on Tuesday.

The lawsuit filed by a student at the Berlin University of Applied Sciences, who had been exmatriculated after the attempted deception, was unsuccessful. He was caught because his exam had the same mistakes as that of a fellow student.

According to the court, the plaintiff made a final attempt after failing two exams in a compulsory module. This was possible due to a special regulation in Berlin that was introduced during the corona pandemic to compensate for restrictions for students: Exams that were not passed in the 2020 summer semester and in the 2020/21 winter semester did not count.
