Higher Labor Court: Termination of Primark works council invalid

The Lower Saxony state labor court has declared the controversial dismissal of a senior works council at the textile discounter Primark to be inadmissible. The chamber said on Friday that a complaint by the company against a decision by the Hanover Labor Court in favor of the employee representative had been rejected. The question was whether Primark could dismiss him without notice for an alleged data protection violation.

According to the Verdi union, the local works council chairman had emailed a draft roster from the home office to members of an arbitration board that was negotiating company working time regulations. Primark then argued that it had forwarded confidential information from a private device in this way, which constitutes a serious violation of internal guidelines. The company wanted to comment on the case late in the afternoon. (dpa)
