The woman who accuses Steven Tyler of sexually abusing her in the 1970s reacts sharply to his recent attempt to reject the lawsuit. Only weeks before the start of the process.

Public interest and late objections

According to the new court documents that are available, Julia Misley demands the rejection of Tyler’s application for dismissal. The Aerosmith front man has “decisive mistakes” in his argument, says Misley. He, a musician living in California, had sexually abused it in several US states-including Oregon, Washington, Massachusetts and California-when she was still a minor. Tyler now claims that they lived together in Massachusetts, where the protective age is 16 years old, and he could therefore not be sued under California’s “Child Victims Act”.

Misley argues that Tyler brought this “right to choose and application” too late. It also contradicts public order to “reward” someone who specifically brings a child to a state with a lower protective age. In the document that aims at a hearing on August 28, it continues that Tyler had failed to assert the limitation periods of the other affected states in good time.

It states that Tyler had already been informed about all allegations in several states when he was responded to April 4, 2025, but had not listed any specific proof of law on Oregon, Washington or Massachusetts. Therefore, he should not use these arguments afterwards.

Tyler’s defense rejects allegations

Tyler lawyer David Long Daniels, on the other hand, emphasizes to Rolling Stone that nothing was missed. The statute of limitations had already been listed as fifth defense in the response to the lawsuit. “This is sufficient to cover all arguments,” says Long-Daniels.

In his application for summary judgment, Tyler argues that Misley does not live in California and thus cannot apply the California law to resume cases of sexual child abuse. Even if the court does not follow this, the lawsuit should at least be limited to California, since possible claims are time -barred in other states.

Long -term allegations and emotional statements

Misley filed her complaint for the first time in December 2022. She accuses Tyler of having sexually abused her in 1973 shortly after her 16th birthday in Portland, Oregon. A three -year relationship followed in which Tyler became her legal guardian. During a stay at the Beverly Hills Hotel, he dragged her into an elevator naked in order to then have sex with her in the pool – an event that is part of her claims for damages due to mental stress.

“I was treated like a sex toy. Like a pet, like an object – it was humiliating,” said Misley in an affidavit that is attached to her latest submission. She describes that witnesses saw her naked during this incident.

Tyler refers to the supposedly mutual relationship

Tyler denies any misconduct and describes the relationship as mutual and loving. In his autobiography Does the Noise in My Head Bother you? (2011) he describes the ratio in detail and mentions the guardianship that was transferred to him by Misley’s parents. He also reports about sex on the plane and the incident in the Beverly Hills Hotel with a “amazed amish family audience”.

In his first lawsuit in 2023, Tyler claimed that he enjoyed immunity as a “guardian” – a defense that a legal expert described against Rolling Stone as “completely crazy”. Tyler has now dropped this reasoning. Misley’s latest submission states that Tyler can no longer remember the guardianship today.

Decision is imminent

The hearing for the application for a dismissal will take place on August 28th in Inglewood, California. Misley and her lawyers insist that California is very interested in punishing sexual attacks by residents of the state. A division into four individual lawsuits is “impossible” and contradicts the public interest.

“The damage is indivisible and the defendant does not call a legal basis for how they could be divided,” says the brief. California is therefore responsible.

Tyler’s lawyer announced that the musician, a bourgeois name Steven Tallarico, would appear on the process. “We are ready,” said Long-Daniels. “We feel very safe with this case.”

Misley had previously reported publicly about her traumatic family history. She felt abandoned by her parents and found refuge in the rock music scene. After an apartment fire and an abortion, she separated from Tyler in 1977, later married and became a mother of seven children.
