According to the court, there is no evidence to support the assertion that the seriously addicted woman, who comes from Lelystad, deliberately administered the GHB to the baby. It has not been established how the girl got the drugs. But the reckless act of the woman did lead to the death of the child, the court concluded, and she is therefore guilty. She took the drugs into the house and used them while she was the only person to care for the child.

The woman took the GHB on the day in question, October 1, 2020, at the end of the afternoon, in the kitchen of her home, where her daughter’s drinking bottle was also located. During the night she noticed that the child was not well. A few hours later, she noticed that the child’s condition had seriously deteriorated. She called 112, after which the emergency services in the house tried to resuscitate the girl. She was taken to hospital in critical condition, where she died on October 3, 2020.

Behavioral experts identified both a drug problem and a psychological disorder in the woman and believed that she cannot return to society untreated. The court has accepted this advice. After her prison sentence and treatment, the Public Prosecution Service can keep an eye on the woman through a measure that influences behavior and restricts freedom that the court has imposed.

The Public Prosecution Service, which had assumed deliberately, had demanded five years in prison and TBS with conditions.
