Tractor driver to court for deadly train accident Hooghalen

The 52-year-old tractor driver from Smilde, who is suspected of causing a fatal train accident near Hooghalen in May 2020, must appear before the court in Assen again. The man was already in court in April, but his case was then postponed.

The reports submitted about the possible cause of this accident raised questions. The court decided that experts should be heard on this matter.

According to the Public Prosecution Service (OM), the Smildeger telephoned when he crossed the level crossing with his tractor. The man denies this, he had just put the phone away, he told the judge in April. At that time he was driving the tractor with a tipper behind it. The approaching train still sounded its horn, but could no longer avoid the tractor with its trailer. The tipper was dragged hundreds of meters. A 58-year-old train driver from Hardenberg did not survive the blow.

ProRail and the Dutch Railways (NS), among others, reported on this accident. This also includes weather conditions. That morning there was rain and ground fog, which may have obstructed visibility.

The court wants to hear four witnesses about their reports. That will happen at a session on Thursday morning.

An expert from ProRail, NS, VOA and an independent expert will appear to answer any questions.
