A man from Helmond goes into jail for five years because he has raped a woman in Eindhoven and Geldrop. The 34-year-old perpetrator TBS was also imposed with compulsory treatment. The court in Den Bosch determined this on Wednesday.
His first victim was his then girlfriend and the mother of his children. The woman was almost seven months pregnant. The Helmonder was also convicted for rape in 2009.
The man has to pay both victims 7,000 euros in grief money. The court also made it clear that, given the seriousness of the crimes and the disorders to which the man suffers, the TBS can last more than four years. The Public Prosecution Service (OM) had demanded six years and TBS with compulsory treatment.
According to the judge, on 1 May 2021, the man felt violently to his former partner. That happened at night, in the house in Eindhoven where they then lived together. The Helmonder took off her pants, pushed her legs apart and did not care and did not care about the woman’s reaction, who did not want sexual contact with him.
Then he raped her. “The floor was then full of blood, it seemed like a slaughterhouse,” the victim said to the police.
The Helmonder denied that he had sex with her on that day. According to his lawyer, the two ex-partners were in a divorce with each other. The victim wanted to put the man in a bad light with a report of a serious crime. She would also have wanted to frustrate the access arrangement with the children. The court sees no reason to question the reliability of the ex of the Helmonder.
Another rape
The second rape, 19 February last year at the victim’s home in Geldrop, known C. partly. According to him, he was satisfied orally satisfied early in the morning and there was a voluntary sex. The judge is convinced that he also pissed his second victim vaginally and that she was injured. Despite the woman’s defense, the man did not stop.
His lawyer also wanted acquittal in this case. She described Eindhoven as a vulnerable young woman, who has declared several points contrary to the truth. She also had difficulty with a explanation from a neighbor.
He had heard sounds of the rape. She wondered if that was possible, because there were four drunk people in an adjacent home.
No doubt
The judge also had no doubt with this rape. The man was reduced to an imputable, because he has been diagnosed with different disorders. A complete picture of his personality was not possible because he refused to cooperate in an investigation.
It has also become clear that C. is a strong user of cannabis and cocaine and that there is a high risk of repeating a sexual crime. Moreover, he refused to take responsibility for his behavior. All in all sufficient reasons for the judge to impose TBS with compulsory treatment.
According to his lawyer, the Helmonder would not be a danger to his environment if he would return to society untreated, so without TBS.
