According to the Public Prosecution Service, there is manifest inattention. The defense of the driver, however, states that the man acutely lost consciousness at the time of the accident and therefore asks the acquittal.
Cynthia Petroons, the father of Ines’ father, disagrees: “We cannot follow the counterparty at all. It is a shame that people want to minimize the consequences and try to make a force majeure situation plausible. In our opinion, there is sufficient evidence that there was no force majeure.”
