The 67-year-old former teacher from Beilen does not have to go to jail for possessing and making child pornography. The man was sentenced to 240 hours of community service and a prison sentence of 180 days, of which 179 days were conditional. He was sentenced to 20 months in prison, of which 12 months were conditional.
The judge expressly took the man’s personal circumstances into account. He is now undergoing intensive treatment and this should not be thwarted, the judge believes. In addition, the man is an informal caregiver for his wife and mother. Major problems would arise if he were to end up in prison, the judge believes. And this for criminal offenses that have already occurred in 2020 and 2021. The settlement of the case has taken too long.
In 2020 and 2021, De Beilenaar secretly made sexually explicit images in class at the CS Vincent van Gogh secondary school in Assen, where he was a teacher at the time. The man also secretly recorded images of women showering at a campsite in France.
The fact that he downloaded and shared child pornography on his computer came to light during an American investigation in 2021. His computers contained more than 19,000 images that could be classified as child pornography of an extremely crude nature.
The man also had child pornography recordings of his grandchild. This made him emotional two weeks ago during the hearing. This child was the apple of his eye.
The judge therefore blames the man for filming and photographing his own granddaughter in this way and for making such recordings of underage students as a teacher in a classroom. The former teacher has thus abused his position ‘and the trust that is usually placed in teachers’.
The public prosecutor also demanded a five-year professional ban. The judge saw no point in this, now that the man is retired. However, he must keep away from child pornography and must not contact minors. An exception is made for his grandchild. He must complete the treatment process that has been initiated.
