The Meloni government decree which prohibited the sale of oral CBD products, also known as Cannabis Light, was suspended by the TAR of Lazio. The administrative court accepted the appeal of an association of hemp growers and traders, who opposed the new restrictions imposed by the provision which came into force on 22 September. The decree equated the compositions for oral use to cannabidiolextracted from cannabis and devoid of significant psychotropic effects, to drugs from table B of the consolidated law on narcotics. The TAR, however, established that the market cannot be blocked nor is it possible to proceed with the seizure of the goods of light cannabis producers. The hearing is scheduled for October 24.

The law decree of 7 August last year would have had a notable impact on trade and access to oral CBD compositions, leading to significant limitations for consumers and challenges for industry players. The provision, in fact, had the main purpose of change the classification of these products, including those that were previously included in the list of commercial products. Such a change would have triggered a number of significant consequences, including substantial limitations to the trade of oral CBS compositions (which until now can be purchased without the need for a medical prescription) and therefore an impact on operators in the sector.

The Italian Hemp Entrepreneurs Association (ICI) reports the Corriere della Seraconfirmed the news of the stop to the decree, on which he had filed an appeal. In particular, manufacturers and retailers had raised objections regarding the failure to involve the Superior Council of Health in the decision. Ici also underlined that the choice to consider cannabidiol as a narcotic or psychotropic substance goes against conflict with community jurisprudence. After the entry into force of the decree, controls and checks were carried out against economic operators, with accusations of violation of the law on narcotics and the consequent seizure of the goods. However, as a result of today’s decision by the TAR, the decree was temporarily suspended until the hearing on the merits scheduled for October 24th.
