On Tuesday, September 30, 2025, the Minister of Economic Affairs introduced the Availability of Goods Act (Wbg) due to serious administrative shortcomings at the semiconductor manufacturer Nexperia. The company in question has its head office in Nijmegen and also has branches in other countries. This decision prevents the goods that Nexperia makes (finished products, semi-finished products) from being unavailable in an emergency situation. The company’s regular production process can continue.

Reason for intervention under the Wbg

The law was implemented in response to recent and acute signals of serious administrative shortcomings and actions at Nexperia. These signals threaten the continuity and guarantee of crucial technological knowledge and capabilities on Dutch and European soil. The loss of this could pose a risk to Dutch and European economic security. Nexperia produces chips for the European automotive industry and for use in consumer electronics.

This measure is aimed at combating this risk. For example, on the basis of the order, decisions within the company can be stopped or reversed if they are (potentially) harmful to the interests of the company, to the future of the company as a Dutch and European company and/or to the preservation of this crucial value chain for Europe. The company’s regular production process can continue.

The commitment of the Availability of Goods Act by the minister is highly exceptional. It was only decided to implement the law because of the significant extent and urgency of the administrative shortcomings at Nexperia. This is a law that the government only applies if there is absolutely no other option. In this case, the use of this law is solely intended to prevent administrative shortcomings at the individual company in question and is not aimed at other companies, the sector or other countries. Parties can appeal this decision to the court.
