KARLSRUHE (dpa-AFX) – The Federal Constitutional Court wants to announce its decision on the controversial packaging tax on disposable packaging in Tübingen on Wednesday (9:30 a.m.). According to the fast food company, a McDonald’s franchisee filed a constitutional complaint. (Ref. 1 BvR 1726/23)

The complaint is directed against a ruling by the Federal Administrative Court from May 2023. The court had decided at that time in Leipzig that Tübingen was allowed to levy such a tax on disposable packaging, disposable tableware and cutlery from sellers of food and drinks. In the lower court at the Baden-Württemberg Administrative Court, McDonald’s (McDonalds) prevailed.

The packaging tax has been in effect in Tübingen since January 1, 2022. The city’s goal is to use the tax to ensure less waste in public spaces.
