Textile shop covers daily needs – no 2G obligation

Regensburg – The administrative court of Regensburg has granted the application of the owner of a fashion shop not to have to adhere to the 2G rule. The 5th Chamber provisionally determined in an urgent decision that the textile business serves to cover daily needs, as the court announced on Thursday. The decision only applies to the applicant’s shop.

The court did not question the 2G rule – according to which only those vaccinated against Corona or those recovered from Corona can gain access – of the regulation, but rather its implementation in individual cases. The supply of suitable clothing serves to cover individual needs, which can arise at any time and therefore on a daily basis. Growing children could need clothing, adults could also need warm clothing in winter, according to the judges.

The court did not see that the need for bookshops or flower shops, which are excluded from the 2G rule in the ordinance, are of greater importance and greater urgency. (DPA)
