The Senate has adopted the Admission to the Supply of Labor Act (Wtta). Employment agencies and other companies that hire out employees are only allowed to do so if they have permission (permit) to do so. The law must provide better protection for employees and in particular for migrant workers. It should also lead to fair competition between companies.
Minister Mariëlle Paul of Social Affairs and Employment: “All migrant workers have the right to fair, healthy and safe work. We are taking a big step forward with this law. Only employment agencies with an authorization (permit) will soon be allowed to hire out employees and migrant workers. This will improve the position of migrant workers and ensure a level playing field for all employment agencies.”
The law will come into effect on January 1, 2027. Companies that want to continue to lend out employees must report to the Dutch Loan Market Authority (NAU) before that date. The Dutch labor inspectorate will start enforcement on January 1, 2028. Lenders who are active on the labor market without authorization will be fined. This fine also applies to companies that use employment agencies, the so-called hirers.
To gain access, lenders must submit a Certificate of Good Conduct and pay a deposit of €100,000. In addition, they must prove that they comply with existing laws and regulations, such as paying the statutory minimum wage. Only then can they get permission to lend people out.
Implementation of law
The implementation of the law will be in the hands of the Dutch Loan Market Authority. The NAU decides on the admission of lenders. The authority also collects signals from the market and advises on improvements. In addition, the NAU designates the inspection bodies that check whether lenders comply with all laws and regulations. The NAU will start its first activities from 2026, such as designating inspection bodies and opening the registration desk for lenders.
This law is an important recommendation of the Boosting Team for the Protection of Migrant Workers (Roemer). In addition to this law, the government has also taken a number of other steps. For example, the Dutch Labor Inspectorate has been expanded by 135 FTE to increase the chance of being caught. Help points have also been opened in various places to help migrant workers with questions or problems. More help points will be added in the coming period. There is also a law before the Senate to make it easier to prosecute serious harm to migrant workers.
