At the proposal of Minister Keijzer (VRO), the Council of Ministers has approved the amendment to the Reinforcing Control of Public Housing Act. In the novella, the minister corrects 3 amendments that are unenforceable or legally untenable.
The novella will now be sent to the Council of State for advice. After the Council of State advice, it can go to the House of Representatives. This then makes it possible for the Senate to consider the bill and the novella simultaneously, so that the law can enter into force as quickly as possible.
2 amendments are completely reversed with this novella. This applies to the amendment on an absolute ban on priority for status holders and the amendment that ensures that the minister processes (technical) building permits if municipalities decide on this too late. In addition, the novella changes an amendment regarding the preferential rights of municipalities, so that this is brought back into line with the protection of property rights. In addition, as intended by the amendment, the pre-emptive right is regulated in such a way that land speculation can be prevented.
The novella was submitted for consultation in October. The consultation shows a lot of support for the proposed changes. The novella has been changed on 1 point. The total validity of a pre-emptive right will again be 16 years, as now, instead of the previously proposed 20 years.
