State Secretary Rutte of Justice and Security wants to put an end to the impunity of escaping from prison and sabotaging an ankle band. The Council of Ministers has agreed to consulting a bill that makes this punishable. This prevents perpetrators who consciously avoid their punishment or to sabotage electronic supervision without consequences.

State Secretary Rutte: “It cannot be that someone who decides to avoid his punishment or sabotage his ankle band, gets away without criminal consequences. With this bill we draw a hard limit: punishments must be served and supervision should not be without obligation.”

The bill provides for the criminalization of self -liberation for anyone who is stuck on the basis of a custodial sentence or custodial measure. In addition, prisoners who serve a prison sentence applies that they are also punishable if they escape during leave or return late. If the prisoner voluntarily reports during leave during leave within 48 hours after escape, no prosecution is possible. In this way, the prisoner within reasonable limits are offered the opportunity to restore the error made by him on his own initiative. In addition, the Criminal Code includes a criminalization for withdrawal from electronic supervision. It is about situations in which someone sabotages the ankle strap or runs empty.

Consultation

The bill is now first for advice in consultation: citizens, organizations in the criminal justice chain and experts are given the opportunity to respond. The reactions are used to further improve the bill before it is submitted to the Council of State for advice and then offered to the House of Representatives.
