Our democratic constitutional state is valuable and built on a solid foundation, but requires permanent attention and maintenance. The conclusions of the State Committee on the rule of law show that various parts of the Democratic constitutional state must be strengthened in order to maintain confidence in the rule of law. For this it is also important to strengthen the position of citizens. This is stated in the cabinet response on the report of the State Committee.

The State Committee on the rule of law has made many important recommendations for properly maintaining the foundations of the rule of law. The Cabinet has examined these recommendations in detail and has already announced many measures in the government program that are (directly) in line with it. For the many measures that the government is committed to, the starting point is that legislation and regulations, supervision and enforcement are now better in line with the real world of people. This focuses on simplification of policy and legislation and well -functioning and understandable implementation.

The government also wants to strengthen the legal protection of citizens. An important measure for this is the bill to give judges the authority to test laws against the traditional fundamental rights in the Constitution. The bill for this is also being consulted today.

Also important for the trust of citizens in the government and the rule of law is a new vision of government procedure behavior. Earlier parliamentary questions have been answered about this.

The government is also committed to strengthening access to law, because it is important that everyone can find a suitable and sustainable solution for a (legal) problem. To achieve that, the government is investing 44 million euros in legal aid, among other things, from 2027: a year structurally 14 million euros in the Legal Counter and 30 million euros for the Social Advocatuur. Also, after referral from the case law, mediation will remain the first 2.5 hours for free in the coming years.

Importance of simplification
