BERLIN (dpa-AFX) – Palestinians in the Gaza Strip have failed in their attempt to ban arms exports to Israel. The Berlin Administrative Court has rejected lawsuits on procedural grounds that challenged the federal government’s approval practices. (Ref. VG 4 K 45/24 and VG 4 130/24)

The court had to decide on two different lawsuits. In one case, the plaintiff argued that the approval practice violated Germany’s obligations under international law. This preventive legal protection can only be granted if it is foreseeable that the Federal Republic will act in exactly the same way again, explained the presiding judge Stephan Groscuth.

In the second case, four Palestinians living in the Gaza Strip – another plaintiff has since died in an attack – attacked a permit for the export of 3,000 portable anti-tank weapons. They wanted this to be subsequently classified as illegal. This would only be possible if there was a risk that the federal government would act in the same way again under the same conditions as in autumn 2023, according to the court./mvk/DP/jha
