In a legal dispute between the fashion house Jost, which operates branches at several locations in the Palatinate and Baden, and the fashion brand Betty Barclay, which runs an outlet store in the Zweibrücken outlet center, the fashion house Jost was able to achieve partial success.
The fashion house Jost had complained that Betty Barclay in the outlet center was also open on certain Sundays around the holidays in Rhineland-Palatinate. The outlet center was once granted permission for special opening hours by state ordinance because it is located near an airport. However, its commercial flights were stopped in 2007.
The 4th Civil Senate has now decided that the Betty Barclay Group is no longer allowed to open its branch in the Zweibrücken outlet center during the Rhineland-Palatinate Easter, summer and autumn holidays as well as on the Sundays immediately before the start of the holiday and after the end of the holiday. If you do this anyway, you may be fined. However, Betty Barclay does not owe the fashion house any damages or information about opening times in the past, as requested by the Jost fashion house.
The Senate did not allow an appeal against the verdict. The verdict is not yet final. The Senate did not allow an appeal against the verdict. The verdict is not yet final.
