Donald Trump has already caused massive damage to the United States during his first four years. But the most consequent blow was the radicalization of the Supreme Court. He did not appoint one, not two, but three conservative judges, all selected by right -wing activists.

Court strengthens Trump’s power

The newly composed court immediately paid dividend: Roe v. Wade and granted Trump immunity for acts committed during his tenure. Now it actively supports the fascist regime of the president reinstated.

The conservative judges already make it difficult to stop Trump’s lawlessness and unconstitutional decrees – including his attempt to abolish the constitutionally guaranteed birth principle. In addition, they allow him to relieve apparently independent supervisory authorities and civil servants in mass and no reason. Even worse: The court decided that Trump can rigrate migrants to third countries with whom they have no connection – even in extremely dangerous states like South Sudan – without a real way to defend themselves.

Today, the court may have issued its most un-American judgment: Trump’s masked immigration hinges allowed people to stop people on the street alone because they speak Spanish or work on construction sites as day laborers. The aim is to review their citizenship and to dine more victims in the government’s deportation machine.

Discharge of independent authorities and obedience to Trump

The dismissal of independent head of the agency was also confirmed: Supreme judge John Roberts temporarily allowed Trump’s dismissal of Rebecca Slaughter, member of the Federal Trade Commission. However, your lawsuit against discharge continues.

A few months ago, it seemed as if even Trump’s court could try to limit its most authoritarian impulses. So it confirmed that Trump was not allowed to deport migrants without proper procedures and ordered the return of Kilmar Abrego Garcia, which the government illegally deported into a notorious prison in El Salvador.

But after Trump ignored the order of the court for months and at the same time started a massive PR campaign against unotent judges, the conservative majority changed its course. Now she is no longer just acting as a lap dog, but as an accomplice in a wave of crimes against the population.

Shadow docket as a weapon

The Court of Justice has made an unprecedented number of decisions about the “shadow docket”-without complete hearing or briefs. They pave Trump the way to implement his fascist plans. In many of these judgments, the conservative judges did not even explain why they support Trump’s attacks on fundamental rights, his migration policy or expansion of power.

In recent interviews, the conservative judges Amy Coney Barrett and Brett Kavanaugh defended this practice and explained Trump’s use of the shadow dock as normal.

Barrett, who is currently marketing a book, said last week that the court could not control “in which a case a case comes to us”, and downturned the decision to abolish the birthplace principle.

“In this case, we didn’t have the question of the right to birth in front of us,” said Barrett Bari Weiss of “The Free Press”. “It was only about whether district courts can issue universal interim orders.”

Kavanaugh’s reason for “Stop and Frisk”

Kavanaugh, in turn, suggested to name the shadow docket “Interims-Docket” and spoke of a “non-partisan” tradition. In fact, Trump called the court as often and successfully for emergency decisions than no president beforehand.

In an approving vote, Kavanaugh explained what conditions “have been taken up for a reasonable suspicion of illegal stay”: The high number of migrants in the Los Angeles area, its accumulation at certain jobs, typical jobs such as day laborers or construction work without papers, as well as lack of English skills. This is sufficient to allow controls.

“It is important: justified suspicion only means that civil servants can stop briefly and ask for residence status,” he wrote. “If the person is a citizen or lawful in the country, it can continue after a short control.”

“No constitutional crisis”?

Barrett said in an interview with Weiss she saw no constitutional crisis: “I think the constitution is alive and healthy. Our country remains committed to the rule of law. We have functioning courts.”

In truth, however, the highest court today works as Trump’s accomplice – and thus significantly exacerbates the constitutional crisis of the United States.
