Arrest for six months, restriction of liberty for up to a year, correctional labor for up to a year or compulsory work for up to 480 hours may threaten those who inflict beatings a third or subsequent times, reports RIA News.
Pavel Krasheninnikov, head of the State Duma Committee on State Construction, noted that it is impossible to ignore previous convictions for beatings, as this indicates an increased danger, people’s tendency to forcefully resolve conflicts. In his opinion, this indicates a stable form of behavior of the accused.
The draft law proposed for consideration by deputies should eliminate legislative gaps. Now, for beatings, the perpetrator receives for the first time under Article 6.1.1 of the Code of Administrative Offenses a fine of 30 thousand rubles or can be arrested for 10-15 days. Repeating the deed leads to an increase in the fine up to 40 thousand, the performance of compulsory work for 240 hours or corrective labor for up to six months. The maximum penalty is arrest for up to three months.
After that, the conviction is sort of nullified. And for the third case of beatings, the punishment comes the same as if it had been committed for the first time in life.
The draft law was prepared after the decision of the Constitutional Court of Russia on the complaint of Russian woman Lyudmila Sakova, who indicated that the current article 116.1 of the Criminal Code (“Beating by a person subjected to administrative punishment”). Under this article, those who were convicted fell into a privileged position in relation to those who were subjected to administrative punishment.
