The family of the girl who died of peritonitis after going to the emergency room three times finalizes a lawsuit

The legal representative of the family of Emma Martínez Gascó, the 12-year-old girl from Castellón who died last Monday from “purulent peritonitis”, is preparing the complaint document that she will present in the coming days to request criminal responsibilities after having met with the Valencian ‘councillor’ for Health, Miguel Mínguez, and having received a large part of the medical reports on the case.

The girl came to three times to the emergency room, two in the Viver health center (Castellón) and another in the Sagunto Hospital (Valencia), but, according to his parents, “no tests were carried out.” Finally, on Sunday the 5th, the girl worsened and went into cardiorespiratory arrest. The SAMU doctors managed to stabilize her, and she was taken to the Clinical Hospital of Valencia where she finally died.

Medical reports

The lawyer explained to EFE that he met with the family last Friday and they gave him reports. The same day they already asked the manager of the Sagunto Hospital to deliver all the medical reports, which they were able to pick up in the ER.

After having maintained contact with the Ministry of Health, the girl’s parents, Beatriz Gascón and Ramón Martínez, along with their lawyer, met this Monday with the ‘councillor’, Miguel Mínguez, a meeting in which they highlighted the “empathy “and good disposition of the minister, who has promised to get them all the necessary information.

Meeting with the prosecution

Today they have also been able to collect other reports at the Hospital Clínico de València, where they have been received by the manager of this center. The SAMU reports are still pending, which transcribes what happened between the moment the girl lost vital signs on Sunday, her resuscitation and her subsequent arrival at the Clinic, where she finally died.

The legal representative of the family is now going to study all the documentation, he explained to EFE, and has indicated that he has received “absolute collaboration” from other professionals such as experts, to collaborate with the case.

It has also already maintained contacts with the Patient Defender association and its legal department, who have also urged the Prosecutor’s Office to investigate the case ex officio. The lawyer is also interested in meeting with the Valencia Prosecutor’s Office to “see if we can all go hand in hand.”

In the opinion of the lawyer “it seems clear that a possible criminal responsibility must be investigated” and for this reason he is already working on the complaint document that he will present when he has all the documentation and information.

For the moment, the autopsy carried out on the minor will be delivered to the Investigating Court No. 10 of Valencia, which is the one that was on duty when the minor died.
