Martell has also acknowledged that there was vaginal penetration during the night of the events at the Sutton nightclub in Barcelona, but that Alves assures that it was consented to, so there was no rape. He asked for immediate release from prison. The lawyer also indicated that in the medical report there was no mention of vaginal injury in any case, so it resulted in the relationship being consensual.
The prosecution’s lawyer tried to show that there is a serious flight risk since Alves has significant financial muscle in Brazil with more than ten companies. He gave a detailed account of what allegedly happened in the nightclub and, like the Prosecutor’s Office, asked that the Brazilian remain in prison due to the evident risk of flight and the seriousness of the facts denounced.
The rapporteur for the resolution, Judge Eduardo Navarro, was to sign a resolution in the next few hours, but everything could be delayed despite the fact that the pressure is maximum and the case is with an inmate in prison, so a quick decision is always prioritized.
