The government is starting an internet consultation on including minimum energy performance requirements for rental properties. The requirements are laid down in the Building Environment Decree (Bbl). Owners of rental properties with an energy label E, F or G must make their property more sustainable to at least energy label D by January 1, 2029. This contributes to a reduction in energy bills and better living comfort for tenants. The value of the home also increases and the home is more future-proof.
During the internet consultation, everyone can respond to the proposed changes. The internet consultation runs from Tuesday, November 11 to Friday, December 19. After the consultation period, the responses will be carefully examined and, if necessary, included in the draft decision.
Landlords can receive compensation for their investment by charging a higher rent. Sustainability will reduce the tenant’s energy bill. To change the scheme so that the investment is more easily reflected in the rental price, an internet consultation will start in early 2026. The improved scheme could come into effect from 2027.
Exceptions
Some types of rental properties, such as monuments, temporary rental properties and small detached rental properties, are exempt from the requirements. Different rules also apply to landlords who have a home(s) within an owners association (VvE) with owner-occupied and rental properties. If a change in common parts within an VvE is necessary to meet the label requirement, the VvE decides negatively about this and sustainability therefore becomes impossible, an exception to the requirements also applies.
Available subsidy
Private landlords can use the simplified and extended Subsidy Scheme for Sustainability and Maintenance of Rental Properties (SVOH). Landlords can receive a maximum subsidy of €15,000 per home. There is currently approximately €126 million available. The subsidy runs until 2030.
Enforcement
There will be no ban on the use of rental properties in the regulations. The supervision and enforcement of the requirements of the Bbl rests with the municipality. Municipalities have a lot of freedom in their enforcement policy. If a landlord does not meet the requirement, the municipality can write to the landlord to improve the rental property to label D.
