Garage box builder Boxkoning may place on a wasteland on the Waanderweg in Emmen 44 business units. The Council of State has determined that.
A resident of the Waanderweg had objected to the arrival of the units. According to the man, there are insufficient parking spaces and therefore a line must go through the permit.
The case has been dragging on for years. The permit was granted by the municipality of Emmen to Boxkoning in December 2021, the following year the municipality dealt with the objections of the local resident. Everything was rejected.
So the resident of Emmen was not satisfied with that. He went to court. In July 2024, a year and a half later, the court made an interim ruling. He seemed to be in favor of the local resident. The court found that the municipality had not properly explained how many parking spaces there are.
In September last year, the municipality came up with a better story that was subsequently processed in the December 2021 permit. The court thought it was so correct to invite the objectioner to a hearing to tell his side of the case. But he didn’t appear.
The man did appeal to the Council of State. He also did not appear on the hearing on April 22 either. With this decision, the Council of State has definitively rejected his appeal against the permit. This allows Boxkoning to get going.
