This is because the right to reversibility is not only economic help for those who remain, but it is the recognition of the contribution that one spouse has made to the construction of the other’s assets and life over decades. Downplaying this time frame meansaccording to the Court, deny the value of long-term sharing. Time, therefore, is not a cold algebraic number, but the thermometer of a human commitment that the law must protect.

Not just calculations: the search for the right balance

Be careful, though: the Cassation it doesn’t ask you to use the ruler blindly. While reiterating that the duration of the marriage is the fundamental pillar, the judges recognize that there are “correctives”. The reality of extended families is complex and every situation deserves a tailor-made suit. In addition to the years of marriage, judges can and must look at other elements to avoid injustices such as:

  • the economic conditions: an attempt is made to protect those of the two women who find themselves in a situation of greater financial fragility;
  • the amount of the divorce allowance: that is, the sum that the ex-wife received every month after the legal separation, which serves as an indicator of the standard of living she was used to leading.
  • cohabitation before the wedding: an increasingly important element that also recognizes the years spent together before wearing the wedding ring.

In any case, the fixed point made by the sentence is that in any case these “extra” criteria cannot override the time duration data. In short, they cannot become an excuse to completely reverse the proportions to the detriment of those who have been married for their entire life.
