The world football association FIFA has failed in an appeal to the Düsseldorf Higher Regional Court and is still not allowed to apply its rules for players’ agents. On Wednesday, the Higher Regional Court confirmed the decision of the Dortmund Regional Court, which had declared key points of the catalog of rules (FFAR) issued by FIFA to be anti-competitive.
Several players’ agents had filed a lawsuit against these FIFA regulations. Among other things, they saw the disclosure of transfer payments and the commission cap as a violation of antitrust law. In addition, the Dortmund judges had ordered the German Football Association (DFB) and FIFA to pay fines of 150,000 euros each. As the national association, the DFB is responsible for implementing the FIFA regulations.
