A decree of the Council of Ministers clarifies the scope of the car liability insurance obligation. Exemptions and new formulas arriving for historic vehicles, cars not suitable for use, vehicles engaged in competitions and vehicles for seasonal use. The changes will come into force in 2026

News in sight for Rc car 2026: the Council of Ministers has approved a legislative decree that corrects and integrates some provisions of legislative decree number 184 of 22 November 2023 on car liability. The provision, passed under preliminary examination, clarifies the perimeter of the insurance obligation as regards vintage cars and cars of historical interest, those not suitable for use, those taking part in races or competitions and vehicles for seasonal use. The measures should be operational in 2026, further details will come later.

VINTAGE CARS

As for the vintage cars and cars of historical interestthe government, transposing the European Directive 2021/2118, introduces the possibility of fulfilling the insurance obligation with formulas different from the traditional car liability insurance: in other words, owners will be able to resort to insurance policies other than car liability insurance by virtue of the “lower accident rate, often being exposed in museum spaces”. The so-called “static risk” is thus introduced: whatever the scheme identified, the essential condition is that it instrument is capable of guaranteeing adequate compensation to any injured parties, in line with the compensation provided for by classic car insurance.

DISUSED CAR

An exception to the insurance obligation has been introduced “for i vehicles unsuitable for use“, i.e. those that are not in a stable condition to be used. Excluded from the exemption (and therefore subject to the insurance obligation) vehicles without easily replaceable components, for example those without a steering wheel, wheels or battery, or even those that have broken down, with an empty tank or with a faulty engine. Vehicles unfit for use include those without an engine or in a state of scrap.

COMPETITIONS

The civil liability of the cars participating in races or competitions sports of any kind can be covered by general insurance contracted by the organization. A “unique” insurance parachute, in short, which replaces individual car liability insurance.

SEASONAL VEHICLES

For i means of transport for seasonal use such as snowplows or boats that go into storage in the winter, the possibility of stipulating agreements is foreseen policies lasting less than one yearthe so-called “interannual policies”. It is unlikely – but it is to be understood – that the definition of seasonal vehicle can apply to motorbikes that are only used in summer.
