Premier, Everton smiles: penalty reduced from 10 to 6 points on appeal

Toffees now fifteenth on 25, with 5 points on third from last place currently occupied by Luton Town

As reported by Football and Finance, today the penalty in the standings for Everton was reduced from 10 to 6 points, after violations of the English Financial Fair Play regulations. The Premier League made this known, making the decision official.

“An independent Appeal Panel has concluded that the sanction for Everton FC’s breach of the Premier League Profitability and Sustainability Rules (PSRs), for the period up to the 2021/22 Season, will be an immediate deduction of six points . This follows the club’s appeal against an Independent Commission’s decision in November 2023 to impose a 10 point deduction for breaching the club’s PSRs.” we read in the note.

“Everton FC appealed the sanction imposed on them on nine grounds, each of which related to the sanction rather than the fact of the breach, which the club admitted. Two of those nine reasons were upheld by the Appeals Board, which replaced the original 10-point deduction with six. This revised sanction takes effect immediately and the Premier League table will be updated today to reflect the decision. The Premier League Board of Directors is satisfied with today’s decision and that the independent disciplinary process, clearly set out in its Rules and agreed by all clubs, has been followed throughout,” concludes the Premier League.

“Although the Club is still processing the Appeal Panel’s decision, we are satisfied that our appeal has resulted in a reduction in the points penalty,” Everton explained in a statement.

“We understand that the Appeal Panel found the 10 point deduction originally imposed to be inappropriate when assessed against the available benchmarks of which the Club informed the Panel, including the position under the relevant EFL regulations and the 9 point deduction that is imposed under Premier League rules in the event of insolvency. The Club is also particularly pleased with the Appeal Panel’s decision to overturn the Panel’s original finding that the Club did not act with the utmost good faith. That decision, along with the reduction of the points deduction, was an incredibly important point of principle for the Club on appeal. The Club therefore feels justified in pursuing its appeal.”

“Despite the Appeal Panel’s decision and the positive outcome, the Club remains fully committed to co-operating with the Premier League regarding the ongoing procedures relating to the accounting period which ended in June 2023. The Club is still assessing the further implications comprehensive of the decision and will make no further comment at this time, other than to thank our Fans’ Advisory Council and other supporter groups throughout this process, and all Evertonians for their continued support and patience,” Everton concluded.
