The provincial tax on second homes was 145 euros last year, three times more than the general tax for families and six times more than for singles. A group of second-home owners successfully challenged that tax. In fact, the province must repay everything, says their lawyer Bart Engelen: “The Council of State has said that the entire regulation does not provide a legal basis for imposing an assessment. So in fact, the overtax is now the entire tax for the years 2022, 2023 and 2024.”
The province is already prepared to repay two-thirds. She sees no problem in that partial refund.
