Can a tent be fished with a tent at night in the lake of recreational area Nijstad in Hoogeveen? Because that is not clear to everyone, it was spoken of more than an hour in the courtroom of the Council of State today.
The questions were put on the table by a company that rents five fishing spots and that then rents out to sport fishermen who want to fish on carp. That happens during the day and at night. The municipality of Hoogeveen has no problem with it. A new zoning plan stipulates that carp can be done during the day and during the night. A tent is allowed. Clear enough, the municipality believes.
But the landlord of five fishing spots is not sure. He fears problems with enforcers. The company today sent two lawyers to the courtroom. “The site is designated for day recreation,” said one of them.
Furthermore, according to the lawyers, it is forbidden to place a camping equipment on the fishing spot. According to them, that prohibition is explicitly stated in the zoning plan. The lawyers wondered if a tent from the fishing shop, which is open on one side, is a camping equipment or not. The tenants of a fishing spot in Nijstad use such hiding tents day and night.
According to the municipality, the lawyers make the case more complicated than he is. “You can’t spend the night there. That’s all,” says a spokesperson for the municipality.
