The proposals of PSC, Comuns and Cs to reform the regulations and avoid this compensation is still pending

Laura Borras she is no longer a deputy of Parliament. The Board of the Catalan Chamber decided this Thursday to withdraw his seat, after the decision of the Supreme Court not to accept the precautionary measures and to leave the order of the JEC to remove her as a parliamentarian. Now the political debate focuses on who will be chosen to replace her in plenary session to be held next Friday. But beyond the dance of names, which Junts still avoids joining in public, there is another issue on the table: the compensation to which Borràs is entitled as former president.

Today, the former heads of Parliament have two economic rights: one severance pay and one Life penssion once they retire. It is not clear that Borràs may be entitled to this bonus when he turns 65, but he will be able to collect compensation, at least until the majority of the Chamber manages to modify the law -as PSC, Comuns and Cs have proposed- that It is still in the parliamentary process. This is a monthly allowance of 80% of the salary for half the time he was in office and with a minimum of a legislature.

More than 112,000 euros per year

Borràs’s salary as president, although she has not received it since July 2022, when it was suspended for the opening of the oral trial, is 10,069.40 euros per month in 14 payments, which is a annual amount of 140,971.60 euros. Therefore, once suspended, you have the right to collect 8,055.20 euros per month, a total of 112,777.28 euros per year. If the law is not changed sooner, you can collect it for the next four years.

To receive it, Borràs must first request it and it is the Ministry of Economy -and not the Parliament- who must make the payment. Although the leader of Junts is sentenced to four years in jail for the crimes of prevarication and documentary falsification, the law does not contemplate any exception, not even in case of conviction for crimes related to corruption, that allows the department directed by Natalia More deny this service. Sources from the ‘conselleria’ limit themselves to saying that they will analyze whether all the “requirements” and “criteria” established by the current regulations are met.

The modifications of the law, pending

Anticipating this situation, and in order to prevent Borràs from being able to collect from public coffers after being sentenced, the PSC, the Comuns and Cs proposed a reform of the law of the statute of the ex-presidents of the Generalitat, which also regulates former presidents of the Catalan Chamber. However, the processing and approval of him has not arrived before Borràs is formally left without the record. At the moment, the first vote in plenary, which corresponds to the amendments to the entirety, has not even been carried out yet.

The proposal of the socialists it is to repeal the law, but with a transitory provision that allows former presidents who are currently in this regime to collect 20% of their salary -instead of 80%- for six months. The commons They also propose annulling this benefit, both for former presidents of the Parliament and those of the Generalitat, but only in case they have been convicted of crimes related to corruption. Finally, the proposal Citizens He goes a step further and proposes to eliminate all the payments to the ex-presidents -without any transience-, to the ‘ex-consellers’ and also the extra allowance to the leaders of the opposition.
