It must have come as a nasty surprise to Johnny de Mol on the day before Christmas Eve: the Article 12 proceedings that his ex-fiancée Shima Kaes has been conducting in the Netherlands to have him prosecuted will take much longer. She has submitted a request for recusal because she has a ‘strong suspicion’ of bias.

Career over

It will be a thorn in the side for Johnny de Mol that he has been haunted for so long by the accusations of his ex-fiancée Shima Kaes. She accuses him of serious assault and attempted manslaughter, but the complaint was dropped by the Public Prosecution Service in October 2022.

It is unclear whether the abuse really took place, but according to the Public Prosecution Service there was in any case not enough evidence. Shima now has an Article 12 procedure underway to force the Public Prosecution Service to prosecute the billionaire’s son, which was substantively dealt with in Amsterdam this month. If it comes to trial, Johnny’s career will be over, she thinks.

Request for recusal

However, Shima suspects that there has been bias since the beginning of the whole issue. She already finds it strange that the Public Prosecution Service treated and dismissed his case with such priority in 2022. “While other well-known suspects of serious offences, such as Marco Borsato and Ali B., have to wait for years,” her spokesman said in a press release.

It appears that Johnny has received ‘preferential treatment’, camp Shima believes. And she thinks the dismissal is shaky. “For example, only three witnesses were interviewed, all of whom were friends with the perpetrator. These persons have made demonstrably false statements. The more than ten witnesses who could confirm the report have all been discarded.”

Dozens of photos

Everything has been ignored, according to Shima’s spokesperson. “Dozens of photos of the victim’s injuries have also been ignored. Including photos of Johnny de Mol’s fingerprints on Shima Kaes’ neck as a result of strangulation,” said the press officer, who also mentions audio recordings and an app message.

The handling of the Article 12 procedure also raises questions, according to Shima. According to her, her new lawyer, Wendy van Egmond, was given far too little preparation time and a request for postponement was not honored. Shima was also unable to attend the treatment and a video call from Ibiza was refused, she says.

Statement of support

Who was present at the Article 12 hearing? A chief public prosecutor and an attorney general have each written a statement of support with the advice to accept the dismissal, according to Shima. “In principle, this could indicate an inappropriate attempt to influence the court’s decision-making.”

Shima fears that they just want to get rid of the case. “A criminal case has also been dismissed with another member of the media family in question, Jeroen Rietbergen,” says her spokesperson, who has the idea that the De Mol family already had prior knowledge of this.

Collusion

Shima now strongly believes that there is ‘collusion and corruption’. “Between the perpetrator and the Public Prosecution Service, as well as the judges who handle the Article 12 procedure. It is highly unlikely that Johnny de Mol had no prior knowledge of the dismissal and its handling by the judges of the Amsterdam Court of Appeal.”

“It is expected that the aforementioned judges intend to confirm the dismissal instead of ordering the Public Prosecution Service to prosecute Johnny de Mol. This will hopefully be prevented by the recusal chamber,” said the spokesperson, indicating that an official recusal request has been submitted.

Whether the request for recusal will be honored and the judges will be replaced will become clear next year.
