The Court of Appeal considered that it had not shown that the company would have been entitled to implement an advertising campaign on the basis of a agreement between it and the actor.

Actor Jasper Pääkkönen has won the dispute over his cars in court.

The so -called Kalsarijärji was about whether Lähdi & Co Oy, who sells The Other Danish Guy, was the right to use the name, picture and brand of Pääkkönen in their marketing.

The Court of Appeal considered the case in Pääkkönen. According to it, the company was not entitled to the advertising campaign. The actor had not given his consent to it.

The Court of Appeal ordered the company to compensate Pääkkönen for the unauthorized use of this name, image and sound for unauthorized compensation required to compensate EUR 300,000. The starting point for assessing the amount of compensation was the amount by which the actor would have agreed to the advertising campaign.

Pääkkönen served as a brand ambassador for The Other Danish Guy in 2021, when the ads on the subject of the dispute were filmed. Pääkkönen’s calculator images ended up on the cover of Helsingin Sanomat, for example, and were also shown on television.

Pääkkönen considered the advertising campaign outrageous. He felt only involved in podcast recordings, which included images for the promotion of podcast for publication on the underwear company’s website. However, the advertising campaign was much wider.

-I would never have agreed to make such a completely inferior Kalsari-TV advertising campaign for this compensation. By no means would I have even considered, Pääkkönen told Iltalehti in April.

Long -term dispute

Pääkkönen sued Läour & Co Oy and claimed compensation of EUR 300,000 from the company. The Helsinki District Court dismissed Pääkkönen’s cover in the summer of 2023.

According to the District Court, Pääkkönen never provided evidence that advertising by The Other Danish Guy was harmful to his personal brand. Also, the advertising campaign did not cause the company’s sales peak.

The Court of Appeal looked at the matter from another angle. According to it, the case did not show that Lähde & Co Oy had the right to carry out an advertising campaign under the Brand Ambassador agreement.

For example, former rap artist Jare Tiiho was heard as a witness in the court. In addition to contract technical issues, Jasper Pääkkönen’s market value and the reputation hazard to him were discussed in the hall.
