On the criminal level only fines for players. The Milan investigation is the sequel to that of Turin

The Milanese investigation tells us about footballers who do not know what to do with his free time (it is the motivation that emerges in the minutes) and, with extreme superficiality, they contract great debts by betting on illegal platforms. But beyond moral or sociological reflections, for the players the story is destined for all probability (if the facts remain those that emerged) to close with minimal consequences on the criminal level and none on the sporting plan. Let’s see why.
1. How was the investigation into bets born?
The Milanese investigation was born from the transmission of documents from the Turin Prosecutor’s Office. It is August 1, 2023 when the Turin Prosecutor’s Office, investigating a Torinese branch of a betting house that held a parallel “accounting” for the play on illegal servers, discovers the name of the then Juventus midfielder Nicolò Fagioli. Fagioli, Sandro Tonali, Nicolò Zaniolo, Alessandro Florenzi are investigated in Turin: it emerges that they played gambling on legal and illegal platforms and had contracted significant debts. The examination of cell phones and interrogations made it possible to understand how the system worked.
2. Why has the Milan prosecutor’s office opened a new betting survey?
Because in Milan the organizers of illegal bets and owners of the jewelry used to hide the lap of money were based in Milan.
3. For this they have to do with the rolex?
The players to return to the debts were addressed to the jewelry because apparently paid with Rolex traceable transfers, other luxury watches and jewels, which however remained in the shop, while the players came out with a workmanship.
2. What measures were issued by the Milan Prosecutor’s Office?
The Guardia di Finanza of Milan performed the seizure of one and a half million euros on the accounts of the “Elysium Group srl”, the company owner of the jewelry (sum equal to the unlawfully achieved profit). He then investigated and requested house arrest for Tommaso De Giacomo and Patrik Friziera for abusive exercise of playing or betting activities (law 401/1989 article 4, under penalty of 3 to 6 years) and for Antonio Scinocca, Antonio Parise and Andrea Piccini for recycling competition (articles 110 and 648 bis penal code).
5. Who are the players investigated?
Several sportsmen are investigated, including 12 players of A: in addition to beans and tonals, in the list there are (with more nuanced role) Florenzi, Zaniolo, McKennie, Perin, Ricci, Bellanova, Buoniuto, Paredes, Cancellieri, Di Maria. The hypotheses of criminal offense are those of violation of law 401/89 (article 4) which prohibits propaganda and the game on unauthorized platforms. The arrest of up to 3 months or 500 euros of fine is expected, but the crime is extinguished for oblation with the payment of 250 euros.
6. What is the role of Nicolò Fagioli and Sandro Tonali?
It is necessary to make a distinction of the positions of tonals and beans to which, in addition to participating in bets and games on unauthorized sites, advertising is also contested with other practice (“they actually acted through the opening of game accounts, they made money deliveries”). The distinction is relevant, as while the offense relating to the participation in bets can be extinct with an oblation of a few hundred euros, having advertised this practice is punished with the joint penalty penalty and fine: this means that it cannot be canceled with the simple payment of a sum of money. In any case, also for this contravention, the penalties are contained and there is no risk of sentence under the final prison sentence.
7. And what do they risk in terms of sports justice?
For sporting justice it constitutes illegal only to bet on football (paragraph 1 of art. 24 of the Sports Justice Code): at the moment, the acts are currently on poker, other games and other sports therefore the players risk nothing.
8. Tonal and beans can be the subject of a new sports process?
It is very difficult for the principle of ne bis in ditto (“not twice for the same thing”: nobody can be tried twice for the same crime) and tonals and beans have already negotiated a conviction for confessed bets. To open a new file, the activity of “recruiters” of other players should be considered a new fact and not to have emerged in the procedure already sold out (in interrogation in Turin tonals specifies that he has already made declarations to the FIGC Prosecutor’s Office): the prosecutor Chiné will evaluate him who has already asked the Acts of the Milan Prosecutor’s Office.
